Ag Overtime Tightened

As of the first of the new year, employers will be required to pay overtime to agricultural workers after they work 55 hours in one workweek. If employees perform nonagricultural work, then overtime must be paid after 40 hours of work, although there still are some situations where an employer may be exempt from paying overtime and minimum wage. Agriculture employers who qualify may apply for a tax credit for a percentage of the agriculture overtime paid throughout 2023. They will be able to submit an electronic application to DOR between January 1 and January 31, 2024.
